Normally this should say "both cards in both hands must play." As that is written someone could aruge it means both cards in the losing hand must play.

Yes there is. Assuming strict rules of both cards must play in both hands...

It's a king high straight flush.

Actually if he had 89 spades I think youd have a case. Why couldnt you opt to play the lower straight flush?
