The guy doesnt get the ring back unless she gives it back. If she doesnt want to give him the ring back he would have to sue her which will cost him, and he will certainly lose anyway.
It does not depend on the jurisdiction ; you are not going to get your damn ring back when it comes out in court that you cheated on her , and that is why the engagement is off. I imagine you would have some shot if she cheats on you, but I still don't think it would be worth suing over in most cases. |

You should star yourself for the stupidest question ever. He GAVE her the ring. That makes it HERS. It would still be hers if SHE had cheated on HIM, although a classy cheating whore would then give it back. [/ QUOTE ] So if I'm given a 4 year scholarship to a University and I fail out of school the 1st semester, I am entitled to ~$50,000? Or would you argue that the Scholarship is just a gift, that, get this, *has conditions*? |

You would not be entitled to compensation for the next three years. I take all my quasi-legal advice from Judge Judy. She always makes the girl give the ring back. It is a gift in anticipation of marriage. There is no issue with who's fault it is. (but maybe that is California law and is different in other states) |

Guy should get it back, no matter how much "fault" he has, period.
Firstly, it is difficult to measure fault. Secondly, he paid for it anyways. Of course women are going to say that the girl should keep the ring, it's to their advantage for social customs to work like that. Don't let women walk on you, it is your conditional gift and you can take it back at any time if she walks away. |

[ QUOTE ]
If I remember my 1L crap (which is a big if), engagements used to be considered binding contracts. In most states, if not all, this is no longer the case. The transfer of the ring as consideration for a promise to marry hasn't been enforceable in a long time. [/ QUOTE ] Gifts given in consideration of marriage are still recognized in many states, for example in NY, where I live. |

The people who go on that show recieve, I believe, enough compensation such that it really is irrelevant to them who gets the ring. |

The trick here is to get her a cubic zirconia. Good ones look as good/better than real diamonds. After getting married, switch it out with the real thing. Hey, she deserves it for not being a materialistic diamondwhore.
If it doesn't work out before marriage, you lost a few hundred instead of a few thousand. Engagement insurance ftw. |
