Default NFL CBA question

There is not a negotiations forum so maybe this is the right place. Gene Upshaw, the nfl players union rep, is taking the postion that if 2007 is an uncapped year the union won't ever agree to a cap again.

Sure you say its PR hyperbole and its unlikely such a scenario arises given the cash cow the nfl is, and maybe if it does come to be Upshaw won't continue to be around so it will be somebody else's problem, but isn't this a poor public negotiating position. I realize its up to the owners and this puts heat on them, but I also think it backs the union into a bad positon for everybody. Its Kinda like the M.A.D. cold war policy. mutual assured destruction. Why take such a potentially disaterous and negative PR stance, even if its liklihood of materializing is quite remote? Whatever happened to "getting to yes" style nice guy?
