Default Considered cheating?

So here's the deal.

A woman and her spouse are in the process of getting a divorce. They haven't kissed, had sex, hugged, said they love each other, etc in 2 years, and have basically mutually agreed that they would be happier with other people. They've already gone over how to split up possessions/money, and also who will take care of the children. Only thing left to finalize the divorce is that in her state, both people need separate addresses, but currently they still live in the same house, so by law they are still married but not emotionally/sexually attached to each other anymore.

If this woman were to fool around with another guy, would this be considered cheating on her husband?

Only if you're crazy-religious. Otherwise, it obviously isn't cheating.

Well, I was considering making a move on said woman -- she is visiting this weekend and I probably won't see her for quite some time after that. I guess that would have generated some interesting discussion, too. She's been with the guy for 10 years or so and has never cheated on anyone, so I'm kind of wondering whether she would consider it that or not, because that could be an inhibiting factor, and I don't want to get involved if she thinks so since she knows I know she's like that and blah blah etc
