Default Flop TP+SD... river decision?

Villain seems fairly solid so far, or at least I haven't seem him get out of line yet. After the flop cap I am basically playing my hand as a draw.

Party Poker 1/2 Hold'em (6 handed) Hand History Converter Tool from FlopTurnRiver.com (Format: 2+2 Forums)

Preflop: Hero is CO with 9[img]/images/graemlins/heart.gif[/img], J[img]/images/graemlins/heart.gif[/img].
UTG calls, 1 fold, Hero calls, Button calls, SB completes, BB checks

Flop: (14 SB) 8[img]/images/graemlins/club.gif[/img], J[img]/images/graemlins/diamond.gif[/img], T[img]/images/graemlins/diamond.gif[/img] (2 players)
SB checks, BB checks, UTG checks, Hero bets, Button calls, SB folds, BB raises, UTG folds, Hero 3-bets, Button folds, BB caps, Hero calls.

Turn: (7 BB) 5[img]/images/graemlins/heart.gif[/img] (2 players)
BB bets, Hero calls.

River: (9 BB) K[img]/images/graemlins/diamond.gif[/img] (2 players)
BB bets, Hero ???

After this river, I can't think of much that I beat. Can I lay this down?

I fold the river pretty fast.

I dont 3-bet the flop but I have to admit that I dont whether I should.

fold as played

dont 3bet the flop, ur likely behind so u have little to protect and flush draws, AK, pairs with a Q ect all cut into ur likely equity and are unlikely to fold to ur flop 3bet so ur not gonna clean up outs and only button is left behind u anyways after bbs raise.

also u have position so theres no fear of a free card play (which i hardly ever see anymore anyways).
