EU Ladbrokes vs Norway ruling
Ladbrokes Challenges Monopolistic EU States
22 February 2007 Ladbrokes continues to challenge member states that infringe EU law by restricting competition and freedom of establishment and says it is encouraged by the actions of the EU Commission in investigating the betting and gaming laws of several EU member states. Ladbrokes is currently appealing in the Dutch courts for the freedom to accept Dutch customers online. In Norway, the company's appeal against the governments rejection of a licence application has led to the case being referred to the European Free Trade Association Court in Luxembourg. The court is expected to issue an advisory opinion on a number of questions relating to whether European states can justify betting monopolies in the single market in March. Ladbrokes' case against the Swedish Government for the rejection of its application of a betting licence is being taken up by the European Court of Human Rights. Commenting on its legal cases in Europe Chief Executive Christopher Bell said: “The single market should apply to betting and gaming as it does to other services and we will continue to challenge those states that restrict competition and choice in betting.” --------------------------------------------------------------------- The European Free Trade Association Court in Luxembourg has now delivered its opinion in favour of Ladbrokes and online gaming, which should be beneficial to the share price of online gaming companies this week.... http://www.dinesider.no/customer/770660/...20-%20final.pdf Richas - who is so lazy he rips off other peoples posts from investment forums in case anyone here is interested.....I have only scanned the full judgement but essentially it is OK for Norway to have a Norwegian monopoly and to restrict Norwegian companies but if a company is regulated and authorised by another EU country they cannot prevent access or ban advertising. Come on poker boys get your licenses in the UK - pay a bit of tax - have access to the whole EU and we will back you in the WTO too....... |

lol...Norway isnt even a member of the EU [/ QUOTE ] It is a member of the free trade area and has to comply with the court's rulings because of this. They just don't pay towards the EU running costs, receive grants from the EU or get any say in the rules!!! |

Re: EU Ladbrokes vs Norway ruling
PPS scratch last post, it is against Norway as I said originally the Swedish Ladbrokes spat is still in the Swedish appeals court and Norway is subject to this EU court.
Note to self don't doubt yourself when reraised in a discussion. |

tl;dr notes? [/ QUOTE ] Single market should apply, say Ladbrokes. Give us a license. No, say Norway, Sweden, Netherlands. Ladbrokes appeals in all cases. Norway case -> monopoly may be okay, but must open market to Euro-licensed companies, also for advertisements (EFTA Court) Sweden case -> European Court of Justice to rule Netherlands case -> still in Dutch appeals court This as I understand it... |
