Default Some NC specific questions

Okay, I am in North Carolina and have a few questions...
Some answer's should be very simple.

1. I play online poker...legal or illegal?
2. I bet on sports online...legal or illegal?
3. I bet on horses online...legal or illegal?
4. I play in a variety of home poker tourney's...anywhere from as little as a $60 prize pool to ~$1,000 prize pools...legal or illegal. (I once heard someone say it was legal if the money wasn't over a certain amount)

Can anyone answer these questions with certainty?

Thanks....just curious.

From my interpretation and IANAL, the answer to all 4 of the above questions is "illegal", with the crime being classified as a Class 2 misdemeanor.

I can only answer #4 with certainty. Illegal. Regardless of whether or not there is a rake, and whatever buyin you set, the answer is the same - illegal.

Now your local constabulary might not CARE, but it is still illegal.

To answer your questions:
Betting on sports is definitely illegal in NC.
Betting on horses is illegal, unless its at a licensed facility if there are any in NC - you can bet on horses over the internet, however, THE FEDS HAVE SPECIFICALLY ALLOWED THAT!

To answer questions 1 and 4, you are going to have to wait for the NC Court of Appeals to decide whether poker is a skill game or a chance game, a case is currently pending. Skill=legal, chance=illegal.

Yes, but states many states make things illegal in that state which are not against federal law.

True - Bandit, cant say for certain what NC says here by way of exceptions contained in Federal Law. I really just couldnt help throwing that line in because of the obvious hypocracy.
