Default Stud ruling question

five players still in at seventh street. Dealer doesnt check to see how many cards are left in the deck and deals the first three players cards. The other two do not get cards. The three that did get cards already looked and the cards are intermingled with their other two down cards.

what now?

the burn cards get shuffled and dealt to the two remaining players
did this happen at the borg?

I would use the burns to complete the deal, but I guess the dealer already messed that up too.

Shuffle up the burns and give them both a card. I don't like that outcome, but I have actually seen rooms where that is the rule (deal down to the last card and then shuffle instead of shuffling before dealing the round).

Sounds reasonable. Except that this is a ten handed rotation game and so they never burn. All that's left is discards.

It's a private game.

Well that makes it pretty easy where to ge tthe cards from. I don't like that solution, but it is pretty much the only available solution.

The discards were shuffled and dealt. I guess it is the only solution, but seemed pretty horrible to me.

Shuffle the muck and the burns, finish the hand,
or take back the cards from the other 3 shuffle them with the burns and finish the hand.
