Eminent Domain Struggles Post-Kelo
Here are two fascinating articles:
http://www.weeklystandard.com/Conten...2/636omxgl.asp http://www.weeklystandard.com/Conten...2/650seaos.asp I predict that battles like this will be increasingly common, because many lawyers and local officials view Kelo as a green light to seize property at will. Whether or not a property is looted will depend on the political ties of the owner(s). |

Re: Eminent Domain Struggles Post-Kelo
Someone explain to me, why the "liberal" members of the court voted for this, but the right side voted against. I would have thought it would be the other way around.

Someone explain to me, why the "liberal" members of the court voted for this, but the right side voted against. I would have thought it would be the other way around. [/ QUOTE ] Generally, liberals (especially academic ones like Supreme Court justices) are in favor of increasing governmental power, especially in matters concerning property and the economy. They seek to limit governmental power only in a few areas, like speech, religion and sex. In contrast, most conservatives seek to limit governmental power, especially in matters concerning property and the economy. |
