Default Who should pay here?

I work for this company, and 2 guys came from other company to help us out. They sent some tool box to my company using Fedex.

Fedex left the tool box outside the company, as the dock that the Fedex truck was trying to park was too crowded. That's what Fedex suppose to do according to the agreement that my company and Fedex has.

Tool box is gone. No one saw it.

So my question is, who is responsible for the lost tool box? In other words, who should pay for it?

was the tool box being given to your company, or was it sent there for the guys who are coming to help out to use? what kind of relationship do you have with this other company? what kind of help are they providing and how much do you foresee them providing in the future? does your company have a fed ex rep? why is there no security camera in the area of the drop off? etc.

Per your agreement with Fedex, the goods were properly delivered.

So, your company "lost" the tool box.

Edit/Add: If you agreed/told the 2 guys to send the tool box via Fedex, then pay up.

Is this an official agreement with FedEx, or do you guys just tell your regular driver "leave it if the loading dock is full"? I'd think you'd be able to file a claim with fedex. All packages sent through them are insured. In the future, expensive small things should be sent "Signature required" so they don't get left anywere.

This is why you insure things from fedex.

However if you have a drop ship agreement with fedex , sounds like you do. Well I'd start looking at the one them nice Snap-on tool boxes ...

I hear what you're saying.

It's just for example, let's say we know each other, and I said I want to go to your house, and you say ok. I say I'll send you my Poker Table 'cause we want to play poker. You say ok. I send it to you but get lost and ask you for the money. It was left outside of your house, and someone stole it. You didn't know that the shipping company would leave it outside. Do you pay for it?

In this case, no, I would not pay for it. But if I leave a note with my shipping guy to leave it on my front porch, unguarded, and it gets stolen, then yes, I would pay for it.
