Washington State Gambling Commission Questioned
I callled the Washington State Gambling Commission today and asked the legal department if they were going to come out to arrest my next door neighbor for playing online poker. The paralegal I talked to just started to laugh. She said that even though you could be charged with a felony they don't have the resources or time to come out and pick on the little guys. She said the main scope of enforcement would be preventing online gambling sites from being based in Washington State and to crack down on facilitators of sites if they were to be found operating in Washington.
I also questioned her on the fact that ONLINE horse betting is still allowed in Washington. She said there are 3 licensed vendors (can you say tax revenue!) in the State of Washington that you can place online bets with. What the hell is this all about. So basically it doesn't sound like we will be arrested if we play online poker in Washington.

Remember folks, we live in a state that has a law in place where if you shoot a Bigfoot, you are criminally liable. Now if you think this online gambling law is insane, how about law makers spending our tax dollars making laws up about fictional characters...??? Don't get into the mind of the politician, scarey place.

I understand that the risk is not worth having a felony on my record. It's just the highly unlikely that you will be charged and if you are and have a clean record you could probably plea down to a misdemeanor. According to the document, online gambling is only illegal in Washington State if a fee is charged. I guess that means rake-free sites are OK to play at.

If I understand how WPEX does it, they charge the fee, then refund it later, so they still charge it and that would not be a loophole. Besides, they are a frigging sportsbook and your money (IIRC) has to pass through the sportsbook on the way in and out so you would be just as big a target for BigBrother there as anywhere.
