Default Ethical question, my daughter is a theif (poll)

I went to the mall tonight with my wife and daughter who is 8 months old. While we were walking through Games by James, after buying a game to play with friends tomorrow night, my daughter managed to grab a small box with a card game in it. We did not see this and actually didn't notice she was chewing on something until the next store (Gymboree halfway across the mall). At that point the wife and I discussed our options and decided that since the baby had chewed off a corner of the box we didn't want to try and take it back and have the dork at the games store try and charge us, plus he was a dink to the customers (not just us) and acted like it was a big deal for him to come ring us up. Had my 7 year old son been with us we certainly would have returned the game and accepted any consequnces (like paying for the $8 game) as a cost of setting a good example, but since the baby won't realize it we decided not to.

Um, you're a thief. I don't see how the clerk's behavior in any way absolves you of yours.

EDIT: All you care about is seeming like good people? Sheesh.

If we're taking a strict moral line, the cost of the item ruined doesn't matter. When I first read I didn't notice it only cost $8, and when I did see that I'll admit I kind of thought, "Meh."

Still, I'd love to see some of those "yes" votes justify themselves.

The true moral resolve to this situation is that your daughter owes teh store $8. The juice should be running too.
