Default Roommate leaves town, what\'s your line?

Background: Roommate is 20 year old female. She moved in a few months ago to replace a roommate who moved back home. She's been a good roommate (didn't leave messes, paid rent/utilities on time, etc.). Recently, she let us know that she was having some financial problems. I don't know the entire details, but she wasn't able to make payments on her car and her loan company was suing her for the money. She's been keeping us updated on the details.

Problem: I returned from a weeklong trip to Chicago on Tuesday. Didn't see roommate that night or next day and thought little of it. It's now Friday and my girlfriend (we live together) and I worry that she may have been arrested (roommate had mentioned she missed a court date because paperwork was being sent to her dad in Texas and he failed to notify her). We make a call to get her number and find out she told some people she was leaving town and going back to Texas. We try calling her and get her voicemail. Thinking she may not answer our calls, we have a friend try calling her. He gets the voicemail too.

We look in her room. My girlfriend insists that she's taken a lot of her stuff. I don't really know as I hardly looked in her room. She has left behind a lot though: TV, DVD player, computer, dresser full of clothes, a closet full of shoes, etc.

Obviously, yesterday was rent day and she hasn't paid. We knew she was moving in August, so this month and next month are the only months we're concerned about.

you aslo legally cant Refuse her entry into house. All she has to do is call the police and they will force you to allow her in.

We've heard that she told people she wasn't coming back. I don't plan on selling her [censored] tomorrow or anything, but what if she comes by to get the rest of her stuff? Do I have the right to refuse her entry if she hasn't paid rent?

She's not on the lease, if that matters at all.

No. You probably can't refuse entry. Why don't you wait to hear from her before you start worrying about her stuff. Like someone said, it's been 2 days.

Selling her stuff might end up getting you in some trouble -- especially since it's only been a few days since she left.

In the end, your only "legal" recourse would be to sue her for the unpaid rent. The fact that she owes you money doesn't give you the right to take/sell her possessions as compensation. You're probably out of luck.

This is why I'm happy I never had to deal with roommates. [img]/images/graemlins/smile.gif[/img]
