I agree with you, and that's what bothers me. If you're drunk and you yell "[censored] the Yankees", cops do nothing. If you're sober and you yell "[censored] the police", you get [censored] with. So it's not about being drunk IMO, it's about what you said (and, obviously, being a moron). Clearly being drunk gives them them the opportunity to take you to the clink, but I don't think anybody should have the right to shut you up when they didn't like what you said, and that goes double for authority figures.

OP, from your pics I think you have one of those looks cops just hate. I know I have a friend like that. If he ever even has to speak to a cop it's usually all we can do to keep him from getting arrested or beaten. He'll just say "what?" with that look and attitude, and it's on.

Sounds like its a violation kip, to which they do not have to read you your rights. Since its really just a "ticket" . every time I been picked up for possession (3 times0 They never did. However being that it is a misdemeanor of some kind still there are some tricks. Like you can request a Jury trial , to which the judge will want to cry and probably let this slide. I did this with one of my Unlic Operator tickets(willfully driving a car w/o or with a revoked lic) which is a misd and the judge knocked it down to almost nothing

"[censored] the police" is certainly protected speech, so if he's not drunk, they can't get him on anything.

Basically, cops are chapped about what he said, so they nail him for being drunk. Say it while sober next time and flip them off.

I don't have the citations, but "[censored] the police" has been upheld as protected in OH. Flipping the bird to a cop has been upheld as protected in PA.
