Hope he read you your rights before taking you to the hospital? either way if charged get a lawyer. AA is absurd unless you believe you have a drinking problem. Consider yourself lucky all you did was damage property and no lives were lost. Fess up to your friends and family and apologize. You have just gotten an expensive lesson in life. Though it could have been worse

[/ QUOTE ] You're an idiot as for the op, if you blew under the limit at the scene, your blood test should prob be under also asuming any meaningfull amount of time passed. also, always wait the maximum amount of time before blowing. Claim you're calling your lawyer or whatever, I think you get something like 2 hours before you're required to blow, that 2 hours can be the deal breaker if you're anywhere close to the limit. I wish you best, and hope you get a phone call today telling you you're fine.

If you're going to lie, next time tell the policeman you had no beers instead of 3. Or better yet, say nothing and get a good lawyer. The police are NOT your friends. If he was your buddy, he would have known you learned your lesson and not have taken you to the hospital in handcuffs!
I doubt there is anyone who drinks and has never driven under the influence of alcohol at least once.

you blew under the limit. this was 2-3 hours you had your last drink, correct?
if so, your bac should be on the way down, such that the blood test would actually register a lower bac than the breath test. all of the alcohol was already into your blood stream - your body was in the process of filtering through it. if you take a breath test like 20 minutes after drinking heavily for 1 hour, your bac will be on its way up for probably about 30 minutes after the breath test. if it took a decent amount of time for you to get to the hospital, i don't think the test is going to come back over 0.08. hopefully it doesn't. i got a dui earlier this year and am currently getting it all resolved. it's quite a pain the ass. my alcohol education class is pretty fun, though.

imo, if you were right at the legal limit, then morally i have no problem with you being on the road. i think that thing is set too low for most people.

[/ QUOTE ] Timeline: accident - 12:00 blow in breathalizer - 12:30 blood test at hospital - 2:15 [/ QUOTE ] you said in the op that you stopped drinking when you went to the strip club. assuming you stayed there for only an hour, you had your last drink at 11 or so. an hour and a half later at 12:30 you blew under the legal limit. then it took almost 2 hours to get a blood test... unless the breathalyzer was off incredibly bad (i believe the tolerance on these is typically +-0.01 or 0.02), you have to be okay. i would think the blood test at the hospital would come out at about 0.04-0.05. good luck.
