i think they really donīt want to prohibit it, as they realized how many of their players know it and use it, so i think it will stay "pending" quite a while

They can certainly detect what programs are running, but as Sharkscope is a web page it might not be possible (?). I'm not certain, but unless it is running something that appears as a process in Windows, I think it could be technically challenging to detect.
Personally, the day I see a warning like that pop up on my screen is the day I switch the bulk of my play (SnGs and some cash) to another one of my accounts and play only special MTT tournaments on Pokerstars. |

They can detect it based on the URL of the site in the titlebar of IE or FF. Anyone who had ever browsed to pokerprophecy OR winholdem.com and got the warning from party poker can attest to this.
