You said "turns up", not "tosses toward the muck". From your description, they were in front of him, not in front of Seat 1 or the Dealer.

In seat 2 at FW the guy had to throw or toss his cards to get them face up across the line.

There are some dealers at FW that would have scarfed up his cards and buried them in the muck, before they came to a stop. Most won't though.

Placing cards face up on the table is not a fold. The dealers that would take his cards need additional training. Of course since they were face up and everyone saw them the dealer snatching them wouldn't make much of a difference.
