Re: Apparently songs are worth $9250 each...Dumb Jury
[ QUOTE ]
In this case you have a woman who purchased cds, ripped them to her computer, and that's it. She didn't download the songs, she bought them, and nobody downloaded the songs from her. But they were on her computer, and in the RIAA world, "making available" is copyright infringement. [/ QUOTE ] WHOA....wait a minute....so if I play my cassette radio REALLY loud while crusing the streets, and some dirtball junkie on the corner can hear the song that he didn't purchase, but which I am making available courtesy the loud volume.....is that considered infringement by the RIAA? Please tell me I'm not breaking the law by inviting a ladyfriend over and putting on some smooth Al Green. [ QUOTE ] * Guns N Roses "Welcome to the Jungle"; "November Rain" * Vanessa Williams "Save the Best for Last" * Janet Jackson "Let's What Awhile" * Gloria Estefan "Here We Are"; "Coming Out of the Heart"; "Rhythm is Gonna Get You" * Goo Goo Dolls "Iris" * Journey "Faithfully"; "Don't Stop Believing" * Sara McLachlan "Possession"; "Building a Mystery" * Aerosmith "Cryin'" * Linkin Park "One Step Closer" * Def Leppard "Pour Some Sugar on Me" * Reba McEntire "One Honest Heart" * Bryan Adams "Somebody" * No Doubt "Bathwater"; "Hella Good"; "Different People" * Sheryl Crow "Run Baby Run" * Richard Marx "Now and Forever" * Destiny's Child "Bills, Bills, Bills" * Green Day "Basket Case" [/ QUOTE ] That's a pretty good list. I think I'm gonna make an RIAA mix tape. |

[ QUOTE ] how dumb can people be? arhg reading this just puts me on stone cold ape tilt how can anyone not admit it's stealing. i can at least respect those who are honest with themselves. is sneaking into an art museum stealing? [/ QUOTE ] that would be trespassing. why would it be stealing? [/ QUOTE ] i don't know about the definition of which crime it is i'm just saying by trespassing you are basically taking money out of the museum's pocket. |

But they were on her computer, and in the RIAA world, "making available" is copyright infringement. [/ QUOTE ] The record companies accused Thomas of downloading the songs without permission and offering them online through a [censored] file-sharing account. [/ QUOTE ] It took me a moment to figure out why you were swearing there! (BTW, that file-sharing program is now in the RIAA's good graces, so it doesn't need to be censored.) The RIAA make the accusation, but they offered no evidence: [ QUOTE ] Of all the documentation presented, the only evidence of any distribution or downloading was that done by Media Sentry, the RIAA's authorized agents. Even if you believe that Thomas was sitting at the PC on the night of February 21, 2005 logged on to [censored] as "tereastarr@[censored]" with a shared folder full of music, there has been no evidence presented by the RIAA that any "actual transfer" aside from the ones from tereastarr@[censored] to the Media Sentry investigator took place. [/ QUOTE ] The RIAA made a good case she had a file-sharing account. Why didn't they include evidence of an act of copyright infringement? |

Re: Apparently songs are worth $9250 each...Dumb Jury
I was going to say how awful of a metaphor that is, but then I realized it's actually pretty good.
So why doesn't the RIAA have border patrol in all museums? |

[ QUOTE ]
The RIAA made a good case she had a file-sharing account. Why didn't they include evidence of an act of copyright infringement? [/ QUOTE ] They didn't have to. The judge ruled that making files available for download constitutes copyright infringement. |

It's more like if someone was charging people to watch a movie in a park, would you be stealing if you watched the movie from across the street? |

[/ QUOTE ] No. There is no right to ask others to not look at my property, except *I think* in stuff like voyeurism. But, rights to privacy, as far as I know, dont extend to things that are outdoors. As the property owner of a song, its up to me how I want is distributed. |
