DUI laws are written in a way that encompasses anything you could take that would impair your ability to drive. If Boston took a legal drug that caused him to pass out while driving he is subject to the same penalties that he would be if he took an illegal substance. If you can't understand why, then you are probably not too bright. |

is he required to take a urine test once he has passed the breathalyzer? i am guessing it is up to the officer's discretion if he wants to arrest the guy (breathalyzer is just a field tool) but is he mandated to take a test?
he apparently passed for all the ones they test for regularly (which i would assume includes opiates, marijuana, cocaine, meth, etc). now they are sending it back for MORE results... seems like they are grasping at straws to me. even if he came up positive for one of these drugs, urine tests are fairly imprecise at determining how recently someone has taken certain substances or how much of it they took. they'll never get a conviction. |
