Anybody intelligent think that Stars did something wrong here?

[/ QUOTE ]

I think it goes against the responsible gambling ethos espoused by Stars to expect someone to be on the hook financially for 2x what they intended to deposit.

I can understand closing his account but I think any further efforts to collect the debt otherwise would be unfair.

The only intelligent way to solve this is an $800 flippament on FTP with Lee.

OP - Please understand that many people come on these forums and tell very similar stories as yours. Often times it is later discovered that they were grossly bending the facts, or just outright lying. The details of how/when everything happened are very important in this situation (in determining whether or not you were aware of the funds' presence). The more concrete details you can provide about when the extra money was deposited and when you were alterted of it, the better.

However, I think a PokerStars rep. ought to chime in and provide the details. This would be the most believable source of information.

As the "story" currently stands, I do not understand why PS cannot negotiate with the OP. The incident was not malicious on his part. It is not as if he is guilty of a chargeback, where negotiating would set an unwanted precedence - thus encouraging others to attempt chargebacks. From what we can tell, this 'glitch' is not reproducible, so they should not be concerned about being exploited.

In a case like this where both parties appear to have errored, a compromise makes sense. Have the OP return $400, and allow him to continue playing on your site.

Update: I figured I'd give it a shot and try to bargain with them and send $400, so I sent them this:

Yes, it is very uncomfortable for me and after speaking with legal
representation today, we have decided that the only fair outcome is for
me
to pay half, $400, and for your company to pay the other half. I did
not, in
any way, do anything wrong. I simply deposited through the steps you
sent
me. Therefore, I ask that you accept my offer to pay $400, and for
Pokerstars to cover the other half. Thank you.

And PS came through in the clutch with:
Thank you for your reply and your interest in resolving this matter.

I have reviewed this situation again. Please note that your
satisfaction is
our best interest and we do appreciate your business. Because of this,
I
have decided to accept your suggestion as I think is fair.

Please proceed to make your $400 deposit and let me know when you have
done so.

Thank you in advance for your cooperation and understanding.

Regards,

Carlos
PokerStars MG Supervisor

thanks for all the input.
