They don't and won't care why their divorcing. Your dad has the potential to lose much more than half. Future earnings, retirement funds are all up for grabs when people who've been married for a long time get divorced. Sounds like your mom doesn't make anywhere near what your dad makes so he'll be on the hook for alimony. My guess is a boat load of it. Your dad needs to find the best lawyer he can afford. Whenever he has an issue or question he should see the lawyer. When it's time to go to court he'll at least be ready. Guys tend to screw themselves long before they ever get to court. Sounds like your dad has decided to do the same thing. Another way to look at it: Even with 100% of his money he's probably miserable and stressed about this anyway. He'll be much happier with only 50% of the money and no crappy wife. |

No, she doesn't make anywhere near what he makes. She doesn't actually make anything really, just spends his money. Despite him paying for her to get a master's degree, she can't hold a job for more than two years.
It's not just 50% of the money (which there really is not much of at all), it's the property too. He comes from Greece where his parents were just farmers in a small poor village. To go from that, to owning 4 properties in America (three of them in very affluent areas on Long Island) has taken a lot of work...Giving it away to "her" would be like throwing away 40 years of his life. So that's it eh? Anyone know the official laws in NY? Is she entitled to half no matter what? I googled this stuff but couldn't find an answer. |

I'm not an expert by any means but I am sure it depends on what state the divorce occurs. I doubt she would be entitled to anything more than half of the marital assets.
