The poker allowed in Florida, and this shouldn’t surprise anyone, is low stakes poker. The spirit of the law ( 752 ) is to increase the limits of poker in Florida while still keeping it low limit. The state regulatory body will most likely create the rules with that low limit bias in mind.
The Seminoles and Miccouskees, through their own gaming commissions, may interpret the law in a way that they will offer mid- to high-stakes games but the state pari-mutuels probably won’t be allowed to offer mid- or high-stakes NL or any limit games with a max bet above $5. I would like to see higher stakes games offered but I don’t think high stakes is what the Florida Senate and House meant to imply or allow with 752. |

florida card rooms care less about its players. they are out to make the most money. if you knew anything about poker and i think you know jack crap, that this is not a good thing. there is a balance that must me made to ensure a game for a long time. by the way you could'nt take my money if i put in your hands.

Let's dispense with another misconception.
Many folks are asserting that an unidentified pari-mutuel will go out on a limb and "Challenge" the "loopholes" in the current statute by offering NL games with buy-ins higher than $100 or 3/6, 6/12 limit structures and ALL BE DAMNED to do something about it. Let's look at the process more closely. First, the DBPR will have on some level an open dialogue with the various pari-mutuels willing to discuss the issues. Remember, these are not "mom and pop" beach front hot dog stands...these are multi-million dollar establishments with significant investments generating substantial tax revenues for the State. The parties will try to hammer out the issues. One side or the other will inevitably have a significant differnce of opinion as to the interpretation of the state of the law. Remember, only the Judical Branch has the real and ultimate final authority regarding the interpretation of law so the posturing that will take place between the pari-mutuels and the DBPR will rise and fall on the strength of their legal arguments coupled with the likelihood that a Judge will agree. If an accommodation cannot be achieved, the pari-mutuel will have to consider the strength of its position and decide whether it wants to challenge the final regulation in dispute. If the pari-mutuel decides to move forward it must create an artifical reason to get its case into Court. It is at this point that the pari-mutuel will spread an "Unacceptable" game such as a 3/6, 6/12 limit or NL game with a buyin higher than $100. The timing of the spreading of this "Unacceptable" game will be communicated to the DBPR in advance so that they will have a response prepared. The goal of all this is to generate a cease and desist letter directed to the pari-mutuel which will serve as a basis to commence litigation. This is a sort of throw back to the civil rights era where civil disobedience was the order of the day. Of course in those days, folks were out getting arrested and their heads kicked in in order to challenge laws. Arrest and beatings were a means of generating social sympathy and attention which is not needed here. The State Attorney's office does not want to prosecute people for playing poker especially under color of law, and the pari-mutuels do not want to be known by the general public as the place where you can go to get arrested for playing poker. By contrast, this will be more "civil" version of "civil disobedience" so don't expect a "bulldozer" showdown between the poker advocates and the evil state. If I had to make a prediction, and for what its worth, the DBPR got their heads handed to them the last go round in Court, and with the recent change of governors, it will be less likely that an EXTREMELY hardline approach will be taken. However, the law is the law, and the bureaucracy (pronounced "bureau" - "crazy") is still the bureaucracy so expect some degree of resistence resulting in an accomodation without resorting to litigation. Perhaps a 3/6 limit spread for hold'em. By the same token, do not look for NL cash games with a buy-in higher than $100 without a Court battle. |

GOOD NEWS ON THE FLORIDA RAKES
Guys ... just got back from Dania where I had a spirited chat with Dorothy, one of the floorpeople in their card room. She was emphatic that they will offer a NL$100 cash game with NO TIME CHARGE. They expect to have the same rake they've been playing, which is a max $5 rake based on the size of the pot. They'll probably also have a $1 jackpot drop, but I didn't get into that.
As for the games, the only one that they're doing for sure is NL$100. We did not discuss other games, but expect a lot of 2/4, 1-5 and 5/5 games, and that room likes to cater to the customer, so they'll spread any game at those levels. The floorpeople were much nicer than usual and the dealers seem anxious for the changeover. One of them said that the owners of Dania Jai Alai (I think it's Boyd, not sure) plan on sinking a lot of money into promoting their card room. Just for kicks, I called Pompano Park (now Isle of Capri) to see what they were going to do, and they said the exact same thing. So, I would conclude that the rake will be just that, without a time charge, which is fan-fricking-tastic. The only thing that could be better is if the Seminoles respond with a bigger NL ring game ... so far no word from them. |

That is great news...Dorothy is very nice, as well as, the rest of my fellow pisanos who run the place.
I never placed much stock in the rumors of a time charge anyway...just didn't make sense. Really, we need to push for a 4/8 game which I think falls in very nicely with the wording of the statute. I played 4/8 all the time on the ships and it is a very profitable game even with the $5 rake. The statute clearly says hold'em can have NL games and 4/8 with a $96 maximum loss (hope I did the math correctly) per hand, falls nicely under the $100 maximum buy-in (i.e. $100 maximum straight out of pocket loss per hand). I think if someone pushes hard enough, the DBPR will come around inorder to avoid another embarassing loss in Court. |

[/ QUOTE ] ANYONE WHO thinks a 3-6 and 4-8 fixed limit game can be beat is a goddamn fool. no fixed limit game can be beat, only spread limits. u outta be pushing for $2-10 spread limits, a very hard game to find and very beatable game. its so easy for u to beat the fish in that game very few casinos willing to offer it cause the good players have too much of an edge. |
