On May 30th, my little brother got $9k wire transferred into his bank account. He's got absolutely no clue where it's from. He's called the bank twice, but apparently he has to talk to someone special, and they haven't been around when he calls. It's been a little while and he hasn't heard anything about it, so he's wondering if he can do anything with it. Let's say he spends every penny of it, and the bank realizes there was some mistake. Will he have to pay it all back, or is the bank held liable for the screwup?

Yes he will have to pay it back if it was a mistake. There may be some statute of limitations on that, not sure.

I'd want something in writing from some sort of manager stating that the funds were mine free and clear before doing anything with it.

Don't be a nit. Take the money. If the bank says anything tell them to blow it out their stupid asses and that your sister/cousin/grandmother in the Ukraine/Poland/Slovakia/whatever sent you that $9k for you to come visit her in the old country and BY GOD YOU ARE GOING TO DO IT! Open an account at another bank, withdraw and deposit into new account. Leave it there for a while, gaining interest.
When they come asking for it, you spent it. When they threaten legal action, you can give it back. |

dont spend it, when the bank discovers the error they will remove it from your account regardless if you have spent or withdrawn it. if its not there, the $9,000.00 you will owe the bank. Take it from me, i used to do this (investigate fraud and collect on bad check writers).
