In TN, where d10 is, he'd be tried for murder, as he reasonably could have retreated (ie drove off) instead of firing his weapon.

I get your point, and that's exactly why I avoid confrontations with strangers, but its misleading to imply he wouldn't be convicted of murder for it.

Yeah, next time I am in town we will have to go out on 85 and teach the residents of A town one by one how to drive efficiently, I think we could help reduce traffic significantly.

wtf? You honestly believe my thought process was "Hey let me pick up this cinder block just in case this guy has a gun" beacuse that will do what exactly for me? I picked up the cinder block to avoid a fight, cause I think there's something about a guy carrying a cinder block that just says "Uhh this guy might be out of his [censored] mind, I should stay away." It's possible if I had just jumped out of my car and confronted the guy with nothing he would have kicked my ass.

While generally if someone rear ends you it's their fault, you cannot brake to induce to collision. Another level of suck is of course when the guy who hits you grabs a crow bar from his trunk...
