Milton, if the owners of epassporte wanted to take all the money they had access to and split town, they could do it anytime they want. This is the price we pay for online poker's current "grey" legal status.

If they ever tried to defend their actions in a court, the idea that "oh and we can take all your money anytime we want" would be held a legally enforceable contractual obligation is zero - it would be interperted as requiring at least good faith, hence good cause.

My point is any of these companies could steal from us any time they want, they dont need to amend their contract to do it.

And if your worry is that they would do this in response to DOJ action, again that risk is not new.

Oh and to Izzy: GET OVER IT, that was just a little good natured ribbing linking you to gaboon, sorry if it wasnt obvious.

I agree with Skall. If they are going to 'split town' not to much we can do. We were not any safer prior to the change of epassporte's terms and conditions.

I just wonder what there purporse was in making those modifications to the terms and conditions?

Skall: Your right. I went over board. I apologize. Just seems like anytime I post on this forum I get ripped a new one (and seems to only happen on this forum). But, I do apologize.

I don't see where it is illegal for any individual in this country to transfer money to Epass from their bank or credit card. To a lesser degree, it could be argued that it isn't illegal for an indivicual to transer money from an online gaming site account to EPASS. (Though I think most would agree that it is probably illegal for an institution to transer money from a US citizen in a State where online poker is illegal TO an online gambling site.

I don't see that the EPASS language does anything that affects us, other than the potential for fees at the end.

I believe some of those "changes" to the TOS were actually in the original TOS. Furthermore, what do you expect epassporte to do when someone loads with a stolen credit card or receives money for a service/good and doesn't send it?

They dont want to take everyone's money when they have a much bigger business opportunity in their hands.

Default You miss a point here. There is NO customer fraud required ....

Again, the Section 8 catch-all is NOT limited to customer fraud or any fraud ...

For country, it says "subject to controlled Account Features", which is linked. It then says:

FWIW I just signed on and selected load from credit card. The load page listed the credit cards that I had successfully funded with in the past. I didn't actually load (that would be the true test of course) but everything appeared normal up to that point.
