You go to the courthouse, you ask around for the small claims folks, they give you a form. You fill out the form and pay something like $50...The court gives you a courtdate, then you need to 'serve' your 'friend' with the paperwork that says "show up in court on X date". You can do this in a few ways (certified mail, process server, etc.). You go to court. In CA, lawyers are not allowed in small claims. Don't know about elsewhere. Unfortunately, if you go to court, and you win, it's not like he goes to jail if he doesn't pay you. If he decides to be a dick, you need to go through additional court proceedings to garnish wages or bank accounts. What winning does is convert your personal 'debt' into a real, legal obligation. He can still get away with not paying in most cases, but it becomes public record, and can mess up his credit, job apps, etc...(unless he works construction or McD's, in which case...who cares) I would give him some more time before bothering with it, and continue to accumulate evidence (as others have suggested). |

This goes a long way in letting him know you're serious. |
