Default Copyright infringement - using people\'s pictures

Hey all - I was just wondering what the rules were concerning using photos that are published on other sites. I see sites like thebrushback.com and wonder, can anyone just take photos from Yahoo! or wherever so long as they site where the photos come from? Is a simple text of "photo taken by the AP" underneath good enough? If I had a blog and posted a picture from the Mets official site, would I just have to say where the pic came from? What if my site generated money for me? Thanks!

James

The copyright law outlines criteria for fair use. Social commentary is one of them.

As long as you host the image yourself, put a subtitle like "this image came from xyz.com" and link to it and don't make huge amounts of money off of it you'll be fine, espcailly b/c you'll be drawing traffic to there website. Be careful though with some larger website(such as mlb, google ect.), sometimes it best to check with them b/c they can really bring the bite to your door.

Does anyone know someone who has got in trouble for this. Im sure that they would start by sending you an email asking that you take down the image.
