The arguement is finely balanced and after a day of listening to the prosecution witnesses it is not looking too bad for them.

It turns out the Gaming commission and police decided not to take any action, but a casino company, RANK, hired a private detection agency to do COVERT operations within the Cardroom. They then sent their evidence to RANK who gave it to the Head of the Gaming Commission who then pressured his staff to bring the prosecution.

NOW it turns out the Head of the Commission is a listed Director of the Private Detective agency company!! Talk about conflict of interest....

Default There is room to argue a \"predominance of skill\" defense

The UK law allows for an express exemption and counts skill where "superlative skill" can overcome chance in games where one or more players compete against each other.

This seemingly opens the door to a predominence of skill defense.

Mixed games are expressly covered, especially banked games where the House is playing.

There is room for a predominance of skill argument under an express exemption for non-banked games.

How many millions of pounds will be spent conducting this trial in order to determine whether superlative skill wins in poker? Ummmmm ... yeah, it does. Duh!

Not as many millions of pounds as they'll get back by introducing taxation on winners if it's found that it is indeed all skill.
