open book\open note tests can still be made incredibly difficult (ie, questions that are much more challenging, cramming lots of questions into a short test time, etc.)

I took 2nd semester engineering Physics my sophomore year. Every test was open book, and the average grade was 45-55%.

If you made the average, you got a 70. People who got 100's were penalized depending on the standard deviation. Generally 100% resulted in a 92/94. Moreover, 85% was an A for the entire semester.

Didn't go to my Legal Studies class for month and a half, didn't read any of the articles assigned, had a 5-page research paper due at noon last Monday, started it at 4am, finished at 11:50 (with lots of dicking around time), slammed an A+. Hardest paper ever to write for me (and I'm a pretty great procrastinator/last-minute writer).
