Though, in reality, how do these laws function? I always assumed that they had little to no effect because of the fact that federal law stated the marijuana was still *illegal*, and that took precedence over state law?

Ask any one who lives in San Fran how this works.

Also, weed is a weed so it's not uber hard to grow.

[/ QUOTE ]

this is correct - however it IS hard to grow well.

Treat your weed plant like it's a weed and show it no love and you grow tall, thin, leggy, weedy weed with straggly buds and a bundle of seeds.

Growing decent bud takes a lot of time and effort but is very rewarding (so they tell me)

Colorado is voting on this as well, although only legalizing for 21+, keeping current penalties for those under 21.

The newest version imposes a $45 per ounce excise tax

[/ QUOTE ]
Ouch thats a lot of juice on an oz.

[/ QUOTE ]

$5.60 an 1/8th might be a pretty big rake, but realize that the price of the marijuana itself will likely drop greatly as these people will be working with growers who do not have to break the law in order to grow. they can do it on open lands w/ permits and pay their workers $3 an hour like every other farm owner.

this will make the price of pot plummet, likely all over the nation.

[/ QUOTE ]

If you look at California's cannibus clubs as an example the price will probably not be drastically affected.

[/ QUOTE ]

Don't they purposely keep the price right at the 'street' price so as to keep people from coming in buying a lot of cheap retail weed and then reselling it in another state or to people under the legal age of 21?

1) Yes, Federal law has supremacy.

The 10th amendment just rolled over in it's grave.

[/ QUOTE ]

The 10th never superseded the "supremacy" clause in article VI:

"This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding."

Regardless, I believe the use of the commerce clause for intra-state activites is an over-reaching interpretation, as I implied earlier.
