What she is doing is not legal though - she must provide at least 14 days notice for a substantial breach of the Residencial Tenancies Act. [/ QUOTE ] Since you haven't done any of those she has to give you at least a month's notice, and since you already started October (assuming you are on a monthly rental period starting on the 1st), I don't think you'll have to move out until November 30. I could be wrong about this last point though. Even if your noise was a substantial breach of the RTA, staying on after your eviction date means she will have to take legal notice and in the meantime you can stay there. Get ready for a legal battle though. Also, the fact that she called your parents is really lame. I recommend that you do indeed stick it to her as hard as you can. Here in Ontario she can't kick you out, she has to go through the tribunal. It's probably the same way in Alberta but I don't know. If you have a lease, she has to abide by it, unless she can PROVE you broke it.
