I believe you are wrong. Please quote the law that states you cannot incorporate.

Can a commodity trader be incorporated? Yes. He is basically doing the same thing as a poker player, playing the edges that he sees. As a CPA I can see no reason why a poker player cannot form a corporation to pay himself a salary.
