It's possible that would fly.
Chess does not have meaningful sponsorship nor other forms of revenue (TV, tickets sales) so the funding is almost entirely by entry fees.

The World Open this year is a $500,000 prize fund based on 1800 entries.

Why has this not been shut down as “gambling”, by the same extension of logic I think you could make a case that it should be allowed for poker also.

Of course life is all about BS and perception, so the percentage of luck in poker as opposed to chess would still keep the wolves at our heels.
