If you havent paid June's rent yet I wouldnt if your deposit is a month and a half like it is in Jersey I would say you were squared away just let them keep it.

obv he should read his lease, but he's obv asking what is really going to happen to him if he does x. if it's for example telling the landlord to use the deposit as the last month's rent in nyc, it is probably breaking 90% of the leases in nyc but nothing will ever happen, as it's standard practice.

I don't know if they manage to pick up every single small judgement there is or if it has to be reported to them. Another poster said to not pay June and live out the deposit if you haven't paid yet. This is what I'd do and I'd never expect to hear from the landlord again unless you were living in a very exclusive property where management may have the time, and possibly the inclination, to pursue you. The average landlord is going to let this slide. It happens to them all the time. Remember, however, that if they sue you and you really mess things up and end up in prison with fellows who 'like' you and the case goes to the Supreme Court.....I don't know who you are and we've never spoken. |

[/ QUOTE ] The part about suing and obtaining a judgment for it to affect your credit isn't necessarily true. If they have a valid contract (ie, a lease), they can provide that to a collection agency and turn the debt over to them. There does not have to be a judgment won to take this step. Most collection agencies report information to the credit bureaus. In short, there is a reasonable chance that something like this could appear as a collection on your credit report and it's not very difficult for the landlord to pursue this action. |
