[/ QUOTE ] During the 2007 WSOP, I operated on "handshake" agreements for the single-event logo deals I did with players (I did a total of 5 deals: Jon "Pearljammer" Turner and Andreas Krause in ESPN-televised preliminary events; Philip Hilm, Alex Kravchenko, and Jerry Yang for the main event.) I don't know yet what procedure I will use at the 2008 WSOP, given that all agents, VIP badges or no VIP badges, will NOT be able to solicit players on the tournament floor and will have to do business in the hallways. I generally will NOT present a player to a prospective sponsor for a 1-year deal (or longer) unless I have a written representation agreement in place. In some cases, I will require a written non-disclosure agreement (NDA) in place before I will show a player a "marketing plan" with privileged information that my competitors do NOT have. The representation agreement can be worded to cover just one particular company or a particular category (i.e. online poker, video games). I don't believe in having complete exclusivity over a player, as I don't believe a single agent can handle all of a player's needs. A typical "Tier 1" player will need to have 2 or 3 different agents: one for poker-related endorsements (i.e. online poker, land-based casinos, video games), one for entertainment projects (paid film and television guest appearances), and one to handle book deals. My agency's core competency is poker-related endorsement deals. A "Tier 1" or "Tier 2" sponsored-player also needs to hire his/her own lawyer who can look over legal documents for the player. A "Tier 1" or "Tier 2" player also need to have a competent tax accountant who has experience dealing with professional gamblers. -- I do know that some players out there will ONLY do handshake deals, as they don't like to sign representation agreements with agents. J.C. Tran and Alex Kravchenko are two examples. |
