Basically, I feel I was as "out-of-control" as someone going 70 in a 65... or someone who doesn't make a complete stop at school crossing. All three (the two examples and my 0.09 are against the law)... but how much danger is it really posing to the general public? MADD, the CA Highway Patrol DUI awareness campaign, and the strict DUI laws were created to catch, prosecute, and put in prison those high risk offenders who habitually drove while being over twice the legal limit. However, like everything else in America; once local governments saw what a HUGE revenue stream DUI cases brought in... they were more than happy to arbitrarily lower the legal limits and venomously prosecute even fringe offenders. BTW... if you believe the hype... and you play on-line poker, you are also breaking the law and probably helping to funnel millions of illegal dollars into our economy (I don't really buy that myself). How would you all like a cop to roll up, see you playing Absolute.com on your laptop, and take you into custody without having to prove a thing.

Wish you the best of luck Bicycles, but I am surprised you didn't just decide to plea down the charge. My DUI ended up costing me $5k after paying for everything including alcohol class, etc. I somehow did not have my insurance premiums go up even after my family switched companies. My Dad moved our whole family to a new policy, it did not ask about DUI anywhere and he double checked with a lawyer and was told it is not his responsibility to report me if they don't ask.
As you see from my other posts in this thread, I feel your pain and came to the smae realizations about DUI laws as you did once properly informed.

FWIW, you're not guilty until proven innocent on this one.
I'm sure there are people out there who are, in fact, impaired at a point lower than .08. If an officer can't do his duty to arrest drivers who drive impaired just because they're lower than an arbitrary number (thank you advocates of .1 - myself included), then they're leaving dangerous drivers on the road. And for what its worth, had you not been breaking one law (speeding), you never would've gotten the DUI for breaking another law (blowing over .08). I feel your pain, and I'm glad you're using your legal rights as an American citizen, but you're being crazy when you do so and then talk about how you have NO RIGHTS as an American citizen. LOL. I've gotten pulled over twice leaving the bars and took the breathalyzer, because I didn't want to go to jail without at least SOME way of helping myself out. Its either I auto go to jail if I don't blow or I can go home if I do and blow under .08 and cooperate with the officer. The only time I even got a written warning was when the cop had a rookie or ride-along with him to help out. Quit talking about having your rights violated. You get your right to an attorney. You had the right to not take the roadside breathalyzer. You get a jury trial. What more could you possibly ask for? You never once had to self-incriminate, you get your due process, and that's how the justice system works.

The guy's handling it quite well, exercising all of his legal rights to defense. He just needs to quit acting like such a victim when he was breaking multiple laws that he well knew about. If I EVER drink and have to drive, its never more than 2 in an entire night, and I drive like a complete nit. I use cruise control in 40 mph zones just so an officer can't say I had an erratic speed.

The whole long post about his rights being violated was just sad. He's handled this very well so far, as I've said before, its just too bad that he had to complain about rights being violated, when, in fact, he's had every right afforded to him.

That's the Sergio I was looking for, but I couldn't find it either...
I'm really not trying to argue one way or the other on this thread, I think my first response today gives my take on things well. The second was kind of making fun of BB for talking about having his rights violated. I do get a kick out of opening a thread and seeing Bron or Sergio. [img]/images/graemlins/smile.gif[/img]
