Have you ever felt sober and fine when you first get in the car, but then a few minutes in, the alcohol kicks in and you realize, "oh [censored]", I'm drunk. Thats not fun.

This isn't my story, but it happened to my brother.
One night he was driving one of his buddies home, his buddy was absolutely blitzed(friend was over 21), my brother had 1.5 beers, but he is underage. The cop gave him a FST(which my brother couldn't pass 100% sober on his best day, because he is clumsy or he was when he was 19 at least). So the cop took him and threw him in jail, where he blew a .02, LAME.
Ohhh yeah this happened on the day before his birthday also, and my parents were in town to take him out to dinner and such, yay!
Lawyer got him off, since he blew a whopping .02 and the cop was just a giant dick.

Ok, so I read some good advice and some bad.

Refusing the Field Sobriety Tests is a refusal and the officer can still ask you to take a BAC test (Blood, breath, or urine). My area does blood. If you refuse to take the BAC test, you are making the penalty more severe. Going through with the BAC, getting a 3rd degree misdemeanor, mostly fines, probably get ARD the first time, and you're pretty much let go. Everyone makes mistakes.

Refuse to take the BAC test, you'll still be charged with DUI, your license will be suspended for at least 1 year, and the fines added on are pretty big. During a DUI stop, you don't have any rights to refuse. At least, that is the law in Pennsylvania. The O'Connell warnings explicitly state this fact, that you do not have any rights to speak with an attorney, lawyer, etc...

There is the machine called a PBT. That is what we call it. You CAN legally refuse that test, and it is only used for suspicion, and can never be used for evidence, except if you are underage. The PBT and Breathalyzer are different machines. The PBT is a quick process, blow in a tube, and it gives you the result. The Breathalyzer is a big machine, you have to calibrate it, test it, etc, and that gives you evidence for the BAC test.

As far as OP, you probably got away with it because you didn't overly exaggerate the conditions of being that drunk. The pen-test is to check if your eyes bounce. Left-to-right is for alcohol, up-to-down is for drugs. The fact that you used everything in you to concentrate probably really separated you from another person who is so drunk, they aren't really thinking about what is going on and are just concentrating on doing the motion.

And one final word...

For someone who is drinking heavily, get in their car, the smell of an alcoholic beverage is incredibly strong. I have smelled it many times and it actually makes me a little sick now. I never noticed it before because I was usually drunk when I was around people too, as many people are.

One little hint, if you are driving drunk, keep all the windows down so that the air circulates. One time we stopped a guy and I was on the passenger side of the car, the window was up, and the guy was so drunk I could still smell it. It's a very distinct odor.

Seriously. Get a lawyer. Mandatory doesn't mean mandatory. That's what lawyers are there for.

Only time I got pulled over after I had been drinking I wasn't drunk yet. I was at a bar 5 minutes from my house and had just pounded 4 shots of Jaeger, paid, and left with the intention of getting home before they hit me. We took a street that had changed speed limits while I was at college and I got pulled over. My friends were loud obnoxious drunk so they made it easy for me.

When the cop asked me if I had been drinking I told him "Nope I'm driving for my friend that just got back from Iraq (which was true)".

No field sobriety test or anything but he made me sit there for 20 minutes while he wrote me a ticket. I was pretty drunk by the end of the stop.

Edit: ItalianFX's post reminded of something the cop said...

"Yeah they must be pretty drunk, I can smell them out here"

I was not completely shitfaced. I had a few drinks and after a few drinks I can still drive better than 99% of females.

I didn't say HOW they can. I obviously didn't tell them to steer towards the road in the center. I said "IF YOU ARE DRIVING DRUNK..."

I CAN'T STOP people from doing what they want, I can only ENFORCE the laws based on the situation that I am presented with.
