Default engagement over who gets the ring?
a guy and a girl are engaged for 8 months as part of a 4 1/2 year relationship.

the guy cheats on the girl and it appears that the relationship will no longer continue due the the wishes of the girl, the guy wants to work things out.

from a non legal standpoint, is the girl entitled to keep the ring if the guy wants it back or should she return it to the guy?

I guess that makes sense, but him cheating on the girl would seem to be a good reason for this 'condition' ending

Probably the fact that he can document his claim to ownership with a receipt and she cannot.

Gift in Anticipation of Marriage/ Breach of said condition. Recognized in some states but not all.

Also, its not that simple, as the fact that the guy cheated may itself be a breach of the condition, thus not allowing him to get the ring back.
