I think tougher if it was a spade. B/c then I don't know if he is protecting 2 pr or is drawing to the flush. But I would likely but him on the flush draw, b/c I don't think he CR as you could take a free card.

I think the hand also depends on how often he has seen you bet when he checks the flop.

I honestly prob raise a good time in this situation, depending on the history to this point.
