His first DUI was in NC, the last 2 were in WV.

Also in WV, I think you have 2 court cases. You have a DMV court for them to take your license, then you have the criminal case.

Also to the poster that has the family issues: I'm not defending his actions, but I've witnessed hundreds or even thousands of people drink and drive and get away with it. Just go to a college/pro football game or a concert. Go to any bar. It's sad, but it happens every day.

I'm just saying he's a good person and I can't really see him doing jail time (in my mind).

I got one when I was 25. 8 months suspended license. It sucked, but the insurance surcharges were the worst part. I live in NJ (which is the highest auto insurance rates in the country), and you don't want to know what I pay in auto insurance.

He's 28, not 23. I've known him for probably 23 years. His tolerance for alcohol is way up there. It's not like his pissing on himself drunk and driving. The legal BAC limit in WV is .08. It doesn't take many drinks to blow that.

In my mind it doesn't matter that he is 28 even. 3 DUI's in 8 years is still bad. Just because it's .08 and he has a "high tolerance" doesn't mean he is still good to drive. That is an awful excuse.

Do you mind me asking what his BAC was the 3 times he got DUI's? Was it .081 all three times?

Your friend needs to learn a lesson. Maybe he needs to go to jail, maybe he doesn't. But he needs to learn a lesson.

Has he received any counseling?

High tolerance + repeated DUIs. But he doesn't have an alcohol problem.
