I guess you're right, mmcd, parents are powerless to prevent their kids, even their 5-year-olds, from stealing their phones and taking them to school.

Your ridiculous scenario, again, has nothing to do with what is going on across America's high schools, namely kids not paying attention to their schoolwork because they are too busy chatting with and texting their little friends.

And you obviously don't see this being a problem because all you care about is getting your [censored] phone back. After all, you NEED your cell phone. You're a LAWYER.

Again, this completely ignores the question of why your KIDS need to have cell phones at school. Maybe because they're YOUR kids, and you're a LAWYER.

[ QUOTE ]

once the parent shows up to retrieve their property, Any response other than "Here you go. Please try to make sure this doesn't happen again." is wrong. The bottom line is that a piece of your property somehow came into the possesion of the school under cirumstances that were at least somewhat beyond your control, and it should be returned to you. If some school official refuses to do so, they would essentially be treating you like one of their students, rather than an adult who is to be treated with respect.

[/ QUOTE ]

What if the property were an expensive bottle of scotch, a Playboy magazine, or xanax (assume Mom has a legal script)? Would you feel differently and why?

There really is no difference because all are against the rules, but not illegal under most municipal codes. Would you file a police report if the principal emptied the booze, flushed the drugs or threw out the skin mag?

A few points:

+I don't know the kid's age;
+I think it was the kid's phone but DaddyLawyer wanted to pretend like it was his
+My understanding was that if they see the phone, they take the phone

I submit the bolded part as my final exhibit your honor.

of course there are differences. the ones you listed would be of concern and some illegal outside of school. the school should call Child Protective Services and file a report if those were found.

a cell phone outside of school is nothing to be concerned about and is only a worry because the school made it against the rules.

I'm pretty sure that schools are so terrible these days that I can't support any of their rules, no matter what they are.

what about a device that beeps loudly every minute? surely you can see that some things that are "ok outside of school" could be considered "inappropriate for in-school use or possession"

so what about hand held video game devices like the PSP? Or what about hand held TVs? Should we allow kids to use those during class?

but i agree, if the teachers confiscated the phone because he was moving it from his jacket, to say, his backpack, then it was a poor move on the teachers part.
