For me it is not LOL, as Party Poker still has not returned us money, has
not shown us proves of our fraud and has not even replied to our emails,
which we were sending day by day for last week (see below), and has not even
confirmed if they received the e-mails or not. The total amount of blocked
money on accounts is exactly over 45K USD.

The e-mails just asked to repeat in written form the facts they told us by
phone:

My Party Poker account was blocked few weeks ago.



I need the official stand of Party Poker about every next points:

1. Please confirm my first and last name, my date of birth, and my account
name, which were registered at Party Poker.

2. Please confirm the date of blockage of my account.

3. Please confirm the exact amount at USD, which was blocked on my Party
Poker account.

4. Please confirm the reasons of blockage of my account.

5. Please confirm the fact, that by security or other reasons (please
mention the reasons, if they are in place here) you have not shown me proves
or evidences of my fraud.

6. If the point (5) is not true, please attach the actual evidences of
violations of rules of Party Poker.



Hope for a quick and full answer from you, as I will forward the e-mail as
official stand of Party Poker for the purpose of further investigation of my
issue.

So, Party Poker is not going to return us money, and also hampers the
progress of investigation of our blockage at player-protection organizations
and leaves us without official written information, which we could show to
our lawyers.

More on this from Party's customer support.

They have specifically said (3 times) to me that use of PokerTracker is not allowed on Party. When I asked them for an application I could use to read my hand histories they suggested, wait for it,... Notepad.

Support staffs do not have the expertise to answer the question properly, so give the safety first response.

It would be a disaster for Party Poker support to say some third party software is acceptable when it is not, and its unreasonable to expect their support staff to have the knowledge to answer the question with reliable accuracy. So saying all software is outlawed is the necessary response. Its best to always be wrong in one direction than risk ever being wrong in the other.

Having said that I have not played at Party for over a year.

I think the fact that you cannot datamine observed hands on Party mitigates to a large extent the perceived 'harm' of these tools. Basically you're getting a summary of hands that you have paid to partake in and witnessed with your own eyes. In this context I see Poker Tracker and other tools as mere 'enhancements'.

Whereas with Full Tilt for example, the ability to record observed hands to me is much more bot-like because the program records data without you even having to be at your computer. So without ever having sat with your opponents before you can possess in-depth knowledge about them. I find this kind of spooky and I could see a case being made for, and would possibly advocate, a banning of PT, Pahud etc. in this context.
