I thought about the whole taking my word for it, but I can say the time and exact location where I hit it. The damange on my car matchs what would happen when you hit a tread (go figure). So I figure its still worth a shot.

they turn it over to their insurance company who will tell you to sue. they know you wont and cant get a lawyer for that amount.

besides you likely would lose as its your responsibility to drive so you have a clear view of the road ahead and can see hazards.

however most municipalities that self insure will pay off any smaller claim if a suit is filed as it costs them too much to defend against it.

Here's an update, although I'm sure most people don't care.

I talked to a lady from the department that runs the expressway. She said they'd send me a form in the mail. I asked what my chances were of seeing any money, and her response was "Slim to None". At least she was honest.

I got the form in the mail, and its not worth my time to fill it out. It wants Police Reports, Witnesses, two estimates, and most of all a description of why they're responsible. So I'm [censored] out of luck here.

JJ,

I care. Needlessly dangerous conditions on highways here in the NY-NJ area bug me to no end.

My top 3:

1. Crap in the road, that clearly didn't just get put there.
2. People who fail to remove snow and, more dangerously, ice from the roof and back of their car.
3. Debris flying out of inadequately secured dump trucks and other trucks.

Honestly, the more I think about it the more I don't think the State should have to pay, but the angrier I get at the trucking companies.

I agree with your list. Especially #2.
