No, I'm not a moron. Yes, I know the risk to reward here makes it clear that you shouldn't do it. Guess what? I even said that in the OP!! Plz to be reading. I was just curious hypothetically if this has any grounds. -Assume tinted windows. -Obstruction of justice seems iffy. Are you really able to be found guilty of obstructing justice by having you and your friend move to the backseat of your car? -Don't comment on who was driving. 5th amendment protects you here, yes? -The seatbelt one could get you I suppose. I think it could be worked around though (don't change seats, insist that court prove you didn't change seats. i doubt office can issue either/or citations that state you were speeding or didn't have you seatbelt). Things like the officer can/should lie, can/should shoot you, etc are potentially valid but are essentially outside of the scope and tone of the question. I'm not suggesting anyone actually execute this; in that case those would be quite relevant. My whole point is the officer should have to prove that you were driving to cite you and it seems to me that if he doesn't see you actually driving that shouldn't necessarily be an easy task. |

Umm could he not just look at the registration/insurance card, check your IDs and ticket the owner or the car? If its not your car mail the ticket or just lie like some other people suggested.

[/ QUOTE ] You're correct that this might be a valid argument to get out of a speeding ticket, but the "ticket" that you would get because of your actions would be WAY worse then the speeding ticket. |
