They sue you personally, but the insurance company has to pay your damages up to the policy maximum. The insurance company would negotiate a settlement (or, if necessary, go to court) on your behalf, b/c they're the ones on the hook.

If you're concerned, you might want to check and make sure that you have a policy liability maximum that you're comfortable with.

Overall this is right, but checking his BI limits at this point won't matter. It's what coverage was in place at the time of the accident, so if he switched now it won't matter for this one.

Make sure you follow the provisions in your insurance policy. You don't want to lose coverage because you failed to follow the policy requirements.

If you have questions let me know, I sue insurance companies for a living.

Complete reversal, but I got myself into a horrible accident w/o a seatbelt and survived with nothing but bruises and very minor cuts(no stitches needed). I hit the gravel shoulder of a two lane highway at about 80mph, over-corrected, and lost control. I went into the corn field which was about 30 feet below the road and rolled the car between 7 and 10 times. The car landed on its top and I crawled out the broken window. Long story short, even though I WASN'T wearing the belt I find it very difficult to drive without one.

In Feb. I was in a bad car accident, I was the only one wearing a seatbelt... 2 of my friends went threw windows(one threw the windshield and the one that was driving went threw the passenger side window), my friend that was driving actually heart stopped a few times and was luckily resusitated. The guy that hit us didnt have a belt on, went threw his windshield and died after hitting the pavement. pretty F#$%# up experience.

Glad you're ok pal. Even though it's not a funny situation, this image immediately came to mind...

on the radio around here they always state whether seat belts were used. it seems all the major injuries and deaths are with those that dont buckle up. to each his own.

I know someone who did something similar. Except he forgot to yield to a stop sign and T-boned a bus. The car was all f***ed up.
