Did nobody else notice the mentions of the doctor appointments, the same that stopped the Jman-boosted HU match? Are the bookies/mob breaking a new bone each week or is it chronic anxiety disorder from worrying about the bookies/mob breaking a new bone each week?

He's being treated for early alzheimers because apparently he is having memory problems and he can not keep track of his financial transations nor can he remember his true intentions when entering into agreements with people.

Either that or he's seeing a psychiatrist and is diagnosed and is being treated for being a scumbag.

Well, here is one legal opinion for free, based on what has been posted in the threads.

1st 30k - to be repaid to payer (i can't see anything in that convo or elsewhere, that says that that initial amount was converted from a loan to makeup - perhaps i am missing something?) and this is more believable than the 2nd loan alleged by the payer as there was no 50% profit payout in addition to the guaranteed capital repayment

2nd 30k - much more complicated

i think what the recipient thought is clear and unchallengeable, if the payer thought something else then there was an unilateral mistake

if there is an unilateral mistake then there was never a meeting of minds and therefore never a contract, it was void, the money is repayable - i.e. the payer wins

but was there a mistake? did the payer really not know what makeup was and though it meant total repayment whatever; which "makeup" doesn't really mean even on the usual interpretation of the words, and would make it an unbelievable good deal

therefore, it's all about what the court thinks (on the balance of probabilities) was in the payer's mind and therefore whether there was (1) a meeting of the minds on the recipients terms or (2) an unilateral mistake

in the payer's favour, he has the "100% no loss" comment, but that is also in keeping with makeup

in the payer's favour, it is his mind and therefore his evidence as to what was going on in it is pretty compelling

in the recipient's favour, the alleged state of mind (i.e. the alleged mistake) produces an unbelievable deal,

in the recipient's favour, i guess he could adduce a lot of expert evidence saying that no one with the payer's experience would think makeup meant the unbelievable deal he alleges he thought it did

i think the judge might just disbelieve the payer on his own statement of mind, so holding that there was a meeting of minds and therefore the recipient wins

p.s. the sound of the payer's emails on the second post is that of a bullshiter, whilst not being blackmail, it stinks of "my solicitor doesn't think im on very strong ground, but i'm gonna say i am, but be dead nice to you and accept less", it's a bit too blatant, if he was that confident he would sue
