Read the decision

Majority did not say that the sentence was, by itself, cruel and unusual punishment. It said that in light of the 2006 change in the law which made the offense a misdemeanor, his sentence was cruel and unusual.

The dissent pointed out:
1. The legislation changing the law specifically said it was not retroactive. Hence the Court was ignoring legislative intent of the law.
2. "Any defendant who was ever convicted in this state for the commission of any crime for which the sentence was subsequently reduced is now entitled to claim that his harsher sentence, though authorized under the statute in effect at the time it was imposed, has since become cruel and unusual and that, as a consequence, he is not only entitled to the benefit of the more lenient sentence, but should be released entirely from incarceration."

Well, it's good to see that the penalty for being black and having sex with a white girl is now only a few years instead of lynching like it was back in the day. Baby steps I guess.
What I can't believe is that this was a 5-4 decision. Let's think about this. Out of nine people who made it to the highest court of Georgia, which presumably means that one would have to be very well educated and successful, four thought that "yes, going to jail for ten years IS a reasonable punishment for getting a [censored] when someone is 17 and the girl is 15."
Personally stuff like this makes me incredibly embarrassed to be an american, especially having been born in the south. I can't even make fun of euros, canadians, aussies, or even non westerners like asians/south americans and the like anymore because quite frankly they are better than us in just about every way.

I think every str8 man under by the age of 18 has recieved a bj. I used to live in GA and I used to get head at my house from the age of 16 and up. I should go to that court room and turn my self in and be put under the jail. This guy was one hell of an athlete and had scholarships offered from all over the SEC and ACC and now he aint got [censored]. TY justice system! Well Played! F***** Racist GA B******s!

I dont think race of girl matters here.

Here is a reasonable punishment for the bj. If he gets caught by girls father then the father can shoot at him if he hits him then he shouldnt have been sneaking with daddy's lil girl. As far as Wilson's father is concerned a hi five and a thats my boy is appropriate.
