1) Regarding paying your taxes the legality is irrelevant, you sill owe tax.
2) It is not whether you should file as a Pro but if you can qualify under IRS regulations without getting denied that claim by the IRS and whether it will lower your taxes or raise them.

Just consult an accountant.
