It all depends on what it says in the contract you agreed to with your insurer. I have never heard of an insurance company that does not include a clause where they don't pay if you're drunk when you wreck your car.

If you did want a policy that included drunk driving, or maybe a clause that paid if your BAC < X where X is over the limit, I expect that the premium would be extremely high.

Put yourself in the position of the insurer, if you were insuring someone, would you want to pay if they crashed while driving drunk?

If you were a good person you would not fight this in court because you are wrong and people who get all litigious in these circumstances only cause premiums to be higher for everyone.
