During the last "winter" here in Az. it got down to the low 20's for 3 days in a row and that about killed every Ficus in the metro-Phoenix area. I spent $600 on my ficus in the front yard and a couple hundred for a few in the backyard and they all bit the big one. I just spent friggin' $400 for a puny (like maybe 5' tall) Brazilian Pepper to replace the dead front-yard ficus.

Trees here in Az. are bank.

One of the sprinklers in our yard stuck up a little too far. The guys who came to mow kept ramming it and breaking it. The sprinkler heads are only like $4 to replace. But after 5 or 6 of them, their bosses finally decided to dig up the whole sprinkler system and fix it for good. It was easier than telling their employees to be careful.

Moral of the story: tie a big red ribbon around the ones you want to save next time.

Ten 50' tall oak trees, if you could even find them to buy, would cost an effing fortune.

Jesus. It's just an expression.

My point is that if they have his money already, he has no options. He'd win in court, but it wouldn't be worth the time and money, and they certainly won't volunteer a refund.

If he hasn't paid them yet, and it sounds like he hasn't, then he has plenty of options. My suggested option is to pay them exactly nothing and remind them of the great deal they're getting.

Yea, I don't know how long it takes an oak tree to grow to 50 ft tall, but it's a long long time.

Thinking about it more, there's probably not an actual "price" for a 50 ft oak tree because there would be no way to move it without killing it. But I am sure that the assessed value in a situation like this would be very high.
